2. conclusion of contract
By placing the products in the online store, Stemarly makes a binding offer to conclude a contract. The contract is concluded when the customer completes the order process by clicking the order button. After completion, the customer receives an order confirmation by e-mail.
3. prices and shipping costs
All prices are quoted in Swiss francs (CHF) and include VAT. Orders with a total value of over CHF 50 are delivered free of charge within Switzerland. For orders under CHF 50, the shipping costs will be displayed at checkout. You can find more information on our shipping page.
4. terms of payment
Accepted payment methods are credit cards and online payments such as PayPal. The payment period is 30 days from receipt of the goods.
5. retention of title
The seller retains ownership of the goods until the purchase price has been paid in full.
For entrepreneurs, the following also applies: Stemarly retains ownership of the goods until all claims from an ongoing business relationship have been settled in full. The buyer may resell the reserved goods in the ordinary course of business; all claims arising from this resale are assigned to Stemarly in advance in the amount of the invoice amount; the assignment is hereby accepted. The buyer remains authorized to collect the claims, but Stemarly can also collect claims itself if the buyer does not meet its payment obligations.
6. shipping and delivery conditions
The delivery time within Switzerland is approx. 2 to 10 working days and for EU countries approx. 3 to 15 working days. Shipping is carried out by Swiss Post. Stemarly accepts no liability for delays caused by the shipping service provider.
7. right of withdrawal and return conditions
Customers have the right to withdraw from the purchase contract within 14 days without giving reasons. The return costs within Switzerland are borne by Stemarly; the customer bears the costs for returns from other countries.
8. liability
Stemarly is only liable for damages within the scope of the statutory provisions. Any further liability, in particular for indirect or consequential damages, is excluded to the extent permitted by law.
9. warranty
The statutory warranty rights apply. Stemarly guarantees that the delivered products are free of defects and correspond to the agreed properties.

11. applicable law and place of jurisdiction
Swiss law applies to all legal relationships between Stemarly and the customer. The place of jurisdiction is Herisau, Switzerland.
